TERMS OF SALES
APPLICATION These General Terms and Conditions of Sale apply to sales transactions concluded by the Hotel Migny.
ARTICLE 1/ COMMITMENT The customer undertakes to comply with and to ensure compliance with all the provisions set out in the general terms and conditions of sale, as well as the legal and regulatory requirements. These conditions of sale may be modified at any time, and the conditions applicable will be those in force on the date on which the reservation is made.
ARTICLE 2/ CAPACITY All customers acknowledge that they have the capacity to enter into a contract, i.e. that they are of legal age and not under guardianship.
ARTICLE 3/ BOOKING CONDITIONS The prices quoted are in euros (€) per room and per night, including taxes and service. Tourist tax is not included and costs €5.20 per adult per night. Rates quoted on the website are subject to change without notice and only the price quoted in the booking confirmation is binding. The reservation will only be effective if the customer guarantees the reservation by providing a valid credit card number and expiry date, which must be valid at the time of the stay. Hotel Migny reserves the right to refuse any reservation if the credit card number is incorrect or the reservation incomplete. When the reservation is made, the credit card will be authorised to be debited. This will only be a pre-authorisation and not a debit. Please note that Prepayment of the stay will be required for all non-refundable bookings. No reason whatsoever may be given for cancelling or modifying a non-refundable booking. For stays of 5 nights or more, prepayment may be required. All bookings for more than 5 rooms must be confirmed by email to direction@hotelmigny.com .
ARTICLE 4/ PROVISION OF ROOMS Rooms are made available from 3pm on the day of arrival and must be vacated by noon on the day of departure.
ARTICLE 5/ CANCELLATION CONDITIONS: The conditions of sale of the rate booked specify the terms and conditions for modifying and/or amending the reservation.
-When the conditions of sale of the reserved fare allow it (flexible offer that can be cancelled/refunded): If the booking was made on our official website www.hotelmigny.com, you should cancel it there by clicking on ‘modify or cancel a booking’. You can also cancel your booking with the hotel by email at reservation@hotelmigny.com or by telephone on 01 48 78 59 97. No charges apply if the reservation is cancelled 2 days before the arrival date, before 2pm (Paris time). After this time, the first night will be charged. The date of receipt of the cancellation request (by email, post or telephone) will be the date on which the reservation is effectively cancelled. If the customer does not turn up at the hotel and there is no cancellation, the amount for the first night will be charged. In application of the provisions of articles L.121-18 4° and L.121-20-4 of the French Consumer Code, no right of withdrawal is applicable to accommodation and/or catering services that must be provided on a specific date or at a specific time.
When the reservation is non-refundable/non-modifiable, no cancellation or modification will be possible for any reason whatsoever.
ARTICLE 6/ NO-SHOW POLICY
In the event of a no-show by the customer on the day of the reservation, the following conditions will apply:
- Invoicing: If the customer does not show up at the hotel without cancelling the reservation, the establishment reserves the right to invoice the full amount of the planned stay. No refunds will be issued for no-shows, as the hotel will have blocked the room accordingly.
- VAT and Compensation: No-show charges are not subject to value-added tax (VAT), as they are considered to be lump-sum cancellation compensation paid as compensation for the loss suffered by the hotel as a result of the client's default. These sums do not constitute the consideration for a service rendered for consideration.
- Terms of payment: Customers who have booked with non-refundable rates or promotional offers are subject to this No Show policy, with no possibility of claiming a refund.
- Intermediary bookings: For bookings made via third-party platforms, the No Show policy remains similar and the customer remains responsible for full payment in the event of a no-show.
ARTICLE 7/ PAYMENT TERMS Payment for all services must be made directly to the Hotel Migny on arrival (except for bookings that are pre-paid at the time of booking). The tourist tax of €5.20 per person per night must also be paid on arrival.
ARTICLE 8/ RELOCATION In the event of force majeure (strike, war, natural disaster, etc....), an exceptional event or technical or organisational problems in the Migny hotel making the customer's stay impossible, the Migny hotel will do everything in its power to find alternative accommodation, if possible in a hotel of the same or higher category. The hotel will bear the cost of the alternative accommodation (additional charge) except in cases of force majeure as detailed above.
ARTICLE 9/ DATA PROCESSING AND FREEDOMS Pursuant to the French Data Protection Act 78-17, customers are hereby informed that their reservation is subject to personal data processing. Users have the right to access and rectify the data entered, which may be exercised by contacting the company's head office. The customer agrees to be included in the hotel's customer file. It is specified that this information will not be communicated to third parties.
ARTICLE 10/ COMPLAINTS Any complaint must be sent by registered post with return receipt to : HOTEL MIGNY - 13 RUE VICTOR MASSE, 75009 PARIS, FRANCE no later than 15 days after the departure date. After this time, no claim will be taken into account.
ARTICLE 11/ INSURANCE - LIABILITY The hotel declines all responsibility in the event of theft, loss or damage to belongings belonging to clients during their stay. The customer will be held responsible for any damage, deterioration or act of vandalism that may occur as a result of occupying the premises and/or as a result of the participants and/or staff for whom he/she is responsible, to movable, decorative and immovable property belonging or not belonging to the hotel. In the online booking process on our website, we cannot be held responsible for any damage resulting from the use of the Internet network, such as loss of data, viruses, service interruptions, etc.
ARTICLE 12/ RECOMMENDATIONS The customer undertakes not to invite any person whose behaviour is likely to be prejudicial to the establishment, the hotelier reserving the right to intervene if necessary.
ARTICLE 13/ STAY AT THE HOTEL In application of French regulations, the customer will be asked to show proof of identity on arrival at the hotel in order to verify his/her origin. The customer accepts and undertakes to use the room with good manners. Any behaviour contrary to good morals and public order will lead the hotelier to ask the customer to leave the establishment without any compensation or refund if payment has already been made. A credit card guarantee will be required on arrival at the Hôtel Migny.
ARTICLE 14/ INTELLECTUAL PROPERTY As regards the use of the Internet site, Hôtel Migny- GMSI holds all intellectual property rights relating to the site. The elements accessible on the site, in the form of texts, photographs, images, icons, sounds, videos, software and databases, are also protected by intellectual and industrial property rights and other private rights held by Hôtel Migny. Unless expressly agreed in writing by Hôtel Migny, it is expressly forbidden to reproduce, exploit, distribute or use for any purpose whatsoever, even partially, elements present on the site, or to distribute a simple hypertext link.
ARTICLE 15/ COOKIES The site may automatically collect standard information, known as cookies, such as the date and time of your visit to the site. Any information collected indirectly will only be used to monitor the volume, type and configuration of traffic using this site. Users are free to oppose the recording of cookies, in particular by using the corresponding functions on their browsers; in this case, access to certain services on the site may be altered or even impossible. ARTICLE 16/ JURISDICTION OF JURISDICTION Any disputes arising from the application or interpretation of these general terms and conditions of sale shall be governed by French law and shall fall within the exclusive jurisdiction of the French courts, within the jurisdiction of the Paris Court of Appeal.
ARTICLE 17/ DISPUTES AND MEDIATION In accordance with the provisions of the French Consumer Code concerning the amicable settlement of disputes, in the absence of an amicable agreement, the consumer may refer the matter free of charge to the consumer mediator to which Hotel Migny belongs, i.e. the Médiation Tourisme et Voyage, within a maximum period of one year from the date of the written complaint sent to the professional.
Referral to the consumer ombudsman must be made by completing the form provided for this purpose on the Médiation Tourisme et Voyage website: www.mtv.travel (Membership through the UMIH union).

ARTICLE 18/ POLICY RELATING TO TELEPHONE ASKING We inform you of your right to register on the opposition list for telephone asking and suggest that you register on Bloctel. Bloctel is the opposition list for telephone canvassing on which any consumer can register free of charge in order to no longer be canvassed by telephone by a professional with whom they have no current contractual relationship, in accordance with Law No. 2014-344 of 17 March 2014 on consumption. The law specifies that it is forbidden for any professional, directly or through a third party acting on their behalf, to cold call a consumer on this list, with the exception of the cases listed by law.

ARTICLE 19/ TOURIST TAX The purpose of the tourist tax is to help the municipalities that levy it to finance expenditure relating to tourist numbers and the protection of natural areas that can accommodate holidaymakers. The holidaymaker must pay the tourist tax to the accommodation provider. The landlord must then pay the full amount of this tax to the City of Paris. The tourist tax rate is €5.20 per adult per night.
ARTICLE 20/ NO RIGHT OF WITHDRAWAL The customer is reminded that, in accordance with article L. 221-28 of the French Consumer Code, he/she does not have the right of withdrawal provided for in article L. 221-18 of the French Consumer Code.
